29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle: a. On or about April 19, 2024, in the production area, employees were required to operate the GED Saws Machine No. 20056 on a daily basis. The employer failed to ensure fingerguards guards were adjusted on the saw to prevent the operator from having any parts of their body in the danger zone during the cutting process. Employees were thereby exposed to the hazards associated with unguarded points of operation during the operating cycles. b. On or about April 19, 2024, in the production area, employees were required to operate the Pneumatic Punch Presses on a daily basis. The employer failed to provide adequately design and construct guards for the equipment to prevent the operator from having any parts of their body in the danger zone. Employees were thereby exposed to the hazards associated with unguarded points of operation during the operating cycles.
