Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards from a Mack Granite dump truck tip-over while off-loading fill dirt. a) Jobsite at 345 Cherry Hill Road Johnston, RI: On or about March 27, 2024, the employer exposed employees to struck-by and crushed-by hazards from a Mack Granite dump truck tip-over hazard while off-loading a load of fill on a softly packed fill pile that caused the truck to be tipped at an angle while dumping.
