OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about March 20, 2024, PepsiCo Beverage Sales, LLC. DBA New Bern Transport Corporation located at 255 Warmington Road SW, Massillon, OH 44646, did not ensure employees were protected from fall hazards. Employees were exposed to falls up to approximately 18 feet 5 inches to the concrete surface below as they are elevated via plastic pallets attached to the forks of powered industrial vehicles.
