29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a) On or about February 28, 2024, the employer did not obtain the manufacturers prior written approval for modifications of the forklift attachment. In that the forklift attachment had been modified by placing a hole in the center of the fork and used to tow un-operational forklifts from trailers. As a result employees were exposed to crushed-by and struck-by hazards.
