OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards: On or about February 8, 2024, and at times prior thereto, in the outside storage rack area where employees were exposed to struck-by hazards while working and walking near damaged racks with bent vertical supports, such as: a. Storage Rack 95 had a damaged, bent vertical support and continued to be used to store crates of stone. b. Storage Rack 78 had a damaged, bent vertical support and continued to be used to store crates of stone.
