29 CFR 1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: An audiometric testing program was not established and maintained by making audiometric testing available for employees performing required duties with noise exposures that exceeded 85 dBA for an 8-hour time weighted average (8-hr TWA). The following employees with exposures that exceeded an 85 dBA 8-hr TWA had not participated in an audiometric testing program, had not been offered an audiometric test and had not received an audiometric test: (a) On February 7, 2024, a Pre-Sort employee was exposed to noise at 79.7% of the permissible daily dose, or an average sound level of 88.4 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 88.4 dBA. (b) On February 7, 2024, a Pre-Sort employee was exposed to noise at 77.2% of the permissible daily dose, or an average sound level of 88.1 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 88.1 dBA. (c) On February 7, 2024, a Pre-Sort employee was exposed to noise at 91.7% of the permissible daily dose, or an average sound level of 89.4 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 89.4 dBA. (d) On February 7, 2024, a Pre-Sort employee was exposed to noise at 70.3% of the permissible daily dose, or an average sound level of 87.5 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 87.5 dBA. (e) On February 7, 2024, a Plastic Sort employee was exposed to noise at 71.7% of the permissible daily dose, or an average sound level of 87.6 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 87.6 dBA. (f) On February 7, 2024, a Paper Sort employee was exposed to noise at 73.6% of the permissible daily dose, or an average sound level of 87.8 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 87.8 dBA. John's Recycling was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1626018, citation number 1, item number 1, group number d and was affirmed as final order on 03/05/2023, with respect to a workplace located at 7311 Omega Circle, Franksville, WI 53126.
