Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each employee a place of employment which was free from a recognized crushed-by hazard that was causing or likely to cause death or serious physical harm to employees: (a) On January 30, 2024, an employee operating the JLG Telehandler was not protected from a crushed-by hazard in that they were operating it without wearing the seat belt.
