OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards while working at or near dust collection system which were not adequately designed to prevent or minimize employee exposure in the event of a deflagraion or other uncontrolled fire event: a) CNC Area, Architectural Door Machine 4199 Oneida St. Bldg A, Denver, CO 80207; On or about January 19, 2024, and at times prior, employees in the wood shop were operating and working within proximity of woodworking equipment that was not serviced by any type of dust collection system nor was the area cleared of dust daily or more frequently. Employees were exposed to explosion hazards due to the design, construction, location, and maintenance of a dust collector system that collected explosive wood dust and did not adhere to one of the following: 1. Located outside of the building. 2. Equipped with listed deflagration suppression system. 3. Equipped with deflagration relief vents with relief pipes extending to safe areas outside the building. 4. Equipped with deflagration relief vents exhausting through listed flame-quenching devices. 5. The collected dust is removed daily or more frequently. b) CNC Area, Edge Machine 4199 Oneida St. Bldg A, Denver, CO 80207; On or about January 19, 2024, and at times prior, employees in the wood shop were operating and working within proximity of woodworking equipment which was serviced by a double filter and bag dust collector system located inside of the building. Employees were exposed to explosion hazards due to the design, construction, location, and maintenance of a dust collector system that collected explosive wood dust and did not adhere to one of the following: 1. Located outside of the building. 2. Equipped with listed deflagration suppression system. 3. Equipped with deflagration relief vents with relief pipes extending to safe areas outside the building. 4. Equipped with deflagration relief vents exhausting through listed flame-quenching devices. c) Table Saw Area, 4199 Oneida St. Bldg A, Denver, CO 80207; Employees operating and working within proximity of a woodworking table saw which was serviced by an single filter and bag dust collector system located inside of the building. Employees were exposed to fire hazards due to the design, construction, location, and maintenance of a dust collector system that collected combustible wood dust and did not adhere to all of the following: 1. Located outside of the building. 2. Equipped with listed deflagration suppression system. 3. Equipped with deflagration relief vents with relief pipes extending to safe areas outside the building. 4. Equipped with deflagration relief vents exhausting through listed flame-quenching devices. 5. The collected dust is removed daily or more frequently.
