Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck-by hazards: a) On or about 01/09/2024 on the shoulder of I-390 northbound, Dansville, New York; employees were performing roadside diagnostics on a tractor trailer that was having mechanical problems. While performing the work, a second tractor trailer traveling northbound, left the travel lane striking the tractor trailer on the shoulder. Two service employees were also struck by the second tractor trailer causing fatal injuries to one employee and permanent disability to the other employee. The employees were not wearing hi-visibility clothing or vests while working roadside at night. NO ABATEMENT CERTIFICATION REQUIRED
