29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average (TWA) of 85 decibels: On or about February 6, 2024, and at times prior thereto, employees who were exposed to hazardous noise level exceeding 85 decibels, were not subjected to audiogram testing in the following instances (a-d): a) At Trim Exterior area: A worker (subcontractor) was exposed to continuous sound levels of 90 dBA, equivalent to 139% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 446 minutes, and zero valve exposure was assumed from a 34-minute non-sampled period. b) At Shingles area: A worker (subcontractor) was exposed to continuous sound levels of 88 dBA, equivalent to 101% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 435 minutes, and zero valve exposure was assumed from a 45-minute non-sampled period. c) At Floor area: A worker (subcontractor) was exposed to continuous sound levels of 89 dBA, equivalent to 114% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 446 minutes, and zero valve exposure was assumed from a 34-minute non-sampled period. d) At Frame area: An employee was exposed to continuous sound levels of 90 dBA, equivalent to 131% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 449minutes, and zero valve exposure was assumed from a 31-minute non-sampled period.
