29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: On or about November 29, 2023, inside the shipping and receiving warehouse located at 6512 Blanchar's Crossing, Windsor, the emergency response plan was not implemented for the employees who were involved with the cleanup of the chemical spill of ethyl acetate: a) The emergency response plan indicated that only employees properly trained to clean up a spill were to do so, and employees had not received training. b) The emergency response plan indicated that they were to follow the specific instructions on the SDS, but did not do so in regard to personal protective equipment.
