29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) The employer does not require the use of any form of eye or face protection while employees use equipment that creates flying particles to include but not limited to pneumatic nail guns. This violation was most recently observed on November 14, 2023, at 3530 Knollwood Lane, Akron, Ohio 44333, where three employees were not protected from eye or face hazards while using pneumatic nail guns to install asphalt shingles on the residential roof. To abate this violation, the employer must ensure that its employees using pneumatic nail guns are protected from flying particles, and that no employee is allowed to use equipment that creates flying particles without the use of eye or face protection.
