29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i) in the following instances: a.) On November 9, 2023, and at times prior thereto, at the Crown Paint Company location in Oklahoma City, OK., employees on the production floor accessed tanks with an unprotected side, exposing employees to a fall hazard greater than four (4) feet to the ground. b.) On November 9, 2023, and at times prior thereto, at the Crown Paint Company location in Oklahoma City, OK., employees on the production floor open a bay door for ventilation, exposing employees to a fall hazard greater than four (4) feet to the ground. c.) On November 9, 2023, and at times prior thereto, at the Crown Paint Company location in Oklahoma City, OK., employees were required to open a gate on the 2nd floor to move product and the gate was not closed following the operation, exposing employees to a fall hazard greater than four (4) feet to the ground.
