OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or crushing hazards when operating front-end loaders with unrepaired defects: Location: 85 East 2nd Street, Bayonne, NJ a. Employees operated equipment which included, but was not limited to, a Caterpillar 980M front-end loader without using seat belts, with non working back up lights, brake lights, head lights, back up alarm, broken windshield, broken cab door glass, and damaged hand rails. The equipment was being utilized for the movement of recycled metal waste in the yard, exposing the operators and yard employees to struck-by and/or caught in-between hazards. Violation observed on or about November 14, 2023
