OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees engaged in woodworking operations were exposed to combustible dust explosion, deflagration, and/or other fire hazards from combustible wood dust: a) Facility-Wide - The employer did not determine the combustibility hazards of wood materials during woodworking operations and failed to conduct a Dust Hazard Analysis (DHA) to identify and document the equipment and areas of the facility where dust fire and explosion hazards exist, on or about October 23, 2023. b) Cabinet Room - Combustible wood dust was not removed at least daily from indoor enclosureless dust collectors, such as a Central Machinery (Model 45378) and Grizzly Industrial wall mounted (Model G0710), on or about October 23, 2023. c) Cabinet Room - A Central Machinery (Model 45378) indoor enclosureless dust collector was located directly next to an exit door, on or about October 23, 2023. d) Facility-Wide - The employer did not provide for effective capture and control of combustible wood dust generated during the operation of woodworking equipment in the Cabinet Room, Sanding Room, and Door Room, on or about October 23, 2023. e) Outside Dust Collector - Combustible wood dust generated by finishing machines such as a Bridgewood belt sander and Bridgewood planer, traveled through a dust collection system which had no protective measures to detect, suppress, contain and isolate any combustible dust fires and/or explosions that were at risk of occurring in or entering the work area, on or about October 23, 2023. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
