29 CFR 1910.119(h)(2)(i): The employer, when selecting a contractor, did not obtain and evaluate information regarding the contract employer's safety performance and program: On or about October 10, 2023, and at times prior thereto, the employer failed to obtain and adequately evaluate the written safety and health programs of the contractor (Aeropres Corporation) that delivers or unloads aerosol propellants from a vendor tanker truck to the bulk storage tanks located in the Aerosol Tank Farm at the Great Bend Kansas facility. The transport driver of a contractor performed work at the facility by participating several tasks in the process of unloading chemical into the pressurized tanks. Employees and delivery employees engaged in off-loading bulk gas propellants activities at the pressured tanks were potentially exposed to fire and explosion hazards from the release of flammable liquids and gases which could result in serious injury or death.
