OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about October 4, 2023, during the construction of a mixed-use (commercial/residential) building, employees were exposed to struck-by hazards from falling loads, while offloading building materials with the use of a tower crane. The employer had developed site specific work rules for compliance with this standard for the shared use of the tower crane by subcontractors and their subcontractors, but the fall zone was not effectively barricaded or otherwise cordoned off or other measures taken to prevent workers from working in the hoisting fall zone during hoisting activities in accordance with the developed plan.
