29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. Wayne Construction Company, LLC located at 860 Jaeger Street, Columbus, OH 43206: On or about October 4, 2023, the employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions during crane/material handling operations in their work area. During the construction of a mixed-use (commercial/residential) building, materials such as but not limited to OSB sheathing were being hoisted and staged with the use of a tower crane by other trade employees. Employees not involved in material handling operations were working within the hoisting route/fall zone of loads being repeatedly lifted over the area they were working, exposing the employees to struck-by hazards.
