OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to or struck by crushing hazards in the hazard zone between the SAV34 Tire Building Machine TB708 and the Bell Drum/Tread Applicator. On and before August 15, 2023, employees operating the SAV34 Tire Building Machine TB708 and working within the Belt Drum/Tread Applicator Zone were exposed to being caught between the moving tread servicer and the machine structure in unprotected areas of the hazard zone. The existing presence sensing safeguarding device, at the time of the incident, did not create a sufficient detection field to cover the entire hazard zone and detect an employee's presence or intrusion into the hazard zone and initiate a protective stop command in all circumstances. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1. Conduct a risk assessment of the SAV34 Tire Building Machine TB708 and the Belt Drum/Tread Applicator to identify the hazard zone and associated task hazards such as described in ANSI B11.0 American National Standard of Machinery, or other recognized risk assessment process. 2. Apply risk reduction methods to eliminate hazardous employee exposure by replacing the original presence sensing safeguarding device and implementing an effective risk reduction measure, such as guards, control functions, devices (such as, but not limited to, an area scanner), that will provide complete protection of the hazard zone of the machine, equipment and any task hazards identified.
