Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by truck(s) operating in reverse gear: a) On or about September 28, 1985, a 1979 GMC Refuse Truck (License Number FA5194) was operated in reverse gear at 4701 Kemble Court, while loader employee(s) were riding on the rear step(s). One feasible and acceptable abatement method, among others,to correct this hazard is to develop and enforce rules and standardize procedures for all back-up operations whereby loader employees are not permitted to ride on steps while backing and requiring the driver to have loader employees in clear view for signalling purposes.
