29 CFR 1910.119(c)(1): The employer did not develop a written plan of action regarding the implementation of employee participation: (a)Ring-neck Energy & Feed, LLC dba Ringneck Energy LLC at 901 Redwood Avenue in Onida, SD 57564: On or about and at times prior to July 9, 2023, the employer did not develop a written plan of action regarding the implementation of employee participation in the company's process safety management program. This condition exposed employees to explosion and fire hazards. Note: Under process safety management, employers must consult with employees and their representatives on the conduct and development of process hazard analyses and on the development of the other elements of process management, and they must provide to employees and their representatives access to process hazard analyses and to all other information required to be developed by the standard.
