29 CFR 1910.28(b)(1)(i): The employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i)(A)-(C). The employer did not ensure that employees blowing down the top of the Zone 1, Zone 2, and Zone 3 Dryer Systems, with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level, were protected from falling. Employees are exposed to falls of greater than 4 feet, approximately 12 feet from the top of the dryer to the catwalk below, that could result in injuries such as contusions, broken bones, head injuries, or death. The following instances were identified: (a) On or about August 10, 2023, employees were tasked with blowing down the top of the dryer systems, exposed to falls of greater than 4 feet and were not protected from falling. (b) On or about August 17, 2023, employees were tasked with blowing down the top of the dryer systems, exposed to falls of greater than 4 feet and were not protected from falling. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
