29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee was protected from falling through any hole that was 4 feet or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems: a) Aggregate Filling Hopper - Rear of Plant - Employees are exposed to fall hazards, approximately 10 feet, in that the employer does not have a fall protection system in place for employees who are required to conduct housekeeping operations on the walking working surface next to the aggregate filling hopper where there is an opening in the grate big enough for the employee to fall through. This condition was observed on or about October 26, 2023. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
