Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer makes no attempt to protect employees from fall hazards as observed while framing work was being done with the absence of required fall protection mitigations. This most recently occurred on August 16, 2023, at a new build residential subdivision located at 1230 Lake Forest, Lot 159, Hebron, Ohio 43205. The employer neglected to safeguard employees conducting framing work at the unprotected side and edge of the garage roof of the new build residential construction worksite. EVT Building LLC had been previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in inspection numbers: 1) 1572692, Citation 1, Item 1, Issued on 14 April 2022 2) 1559472, Citation 2, Item 3, Issued on 05 NOVEMBER 2021 3) 1476705, Citation 1, Item 1, Issued on 05 JUNE 2020 3) 1475141, Citation 1, Item 3, Issued on 26 MAY 2020 Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
