OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing jobs duties: (a) On or about July 26, 2023, at Worksite adjacent to 8605 Boulder Brook Road, Madison Alabama 35756 - employees were exposed to the hazards of high heat while working outside in direct sun, during the performance of their job duties including forming concrete curbs for approximately 10-hour shifts. Employees performing light to moderate manual labor were exposed to temperatures of approximately 93 degrees F (33.8 degrees C) with relative humidity levels of approximately 47 - 100%. The calculated Wet Bulb Globe Temperatures (WBGT) between 5:53am and 2:53pm ranged from approximately 71 - 88 degrees Fahrenheit with a Heat Index up to 99 degrees Fahrenheit. An employee assigned to perform concrete finishing experienced adverse health effects such as, but not limited to, heat cramps and vomiting, from exposure to the hot work environment. (b) On or about July 27, 2023, at Worksite adjacent to 8605 Boulder Brook Road, Madison Alabama 35756 - employees were exposed to the hazards of high heat while working outside in direct sun, during the performance of their job duties including forming concrete curbs for approximately 10-hour shifts. Employees performing light to moderate manual labor were exposed to temperatures of approximately 94 degrees F (34 degrees C) with relative humidity levels of approximately 50 - 97%. The calculated Wet Bulb Globe Temperatures (WBGT) between 5:53am and 2:53pm ranged from approximately 73 - 93 degrees Fahrenheit with a Heat Index up to 102 degrees Fahrenheit. An employee assigned to perform concrete finishing experienced adverse health effects such as, but not limited to, heat exhaustion, from exposure to the hot work environment. He reported his symptoms to a foreman and left work early. (c) On or about July 28, 2023, at Worksite adjacent to 8605 Boulder Brook Road, Madison Alabama 35756 - employees were exposed to the hazards of high heat while working outside in direct sun, during the performance of their job duties including forming concrete curbs for approximately 10-hour shifts. Employees performing light to moderate manual labor were exposed to temperatures of approximately 94 degrees F (34 degrees C) with relative humidity levels of approximately 46 - 85%. The calculated Wet Bulb Globe Temperatures (WBGT) between 5:53am and 2:53pm ranged from approximately 78 - 94 degrees Fahrenheit with a Heat Index up to 107 degrees Fahrenheit. An employee assigned to perform concrete finishing, experienced adverse health effects such as, but not limited to, heat cramps, vomiting, syncope, dehydration and death, from exposure to the hot work environment. As a result of the exposure, the employee died while being transported to a local hospital.
