29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On July 27, 2023, and at times prior, the employer does not require the use of any form of fall protection while working on the roof of a residence. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were not protected from fall hazards of up to 25 feet while performing roofing activities. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls and that no employee is allowed onto a roof more than six feet high without adequate fall protection. (b) On July 27, 2023, and at times prior, the employer does not require the use of any form of fall protection while working on the roof of a garage. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were not protected from fall hazards of up to 8 feet while performing roofing activities. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls and that no employee is allowed onto a roof more than six feet high without adequate fall protection. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1630818, Citation 1, Item 1, and was affirmed as a final order on February 22, 2023, with respect to a workplace located at or near 5639 Niagara Drive in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1626146, Citation 1, Item 1, and was affirmed as a final order on February 1, 2023, with respect to a workplace located at or near Lot 22 Whispering Ridge in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1605507, Citation 2, Item 1, and was affirmed as a final order on August 09, 2023, with respect to a workplace located at or near 4404 Elk Ridge Drive in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1592324, Citation 1, Item 1, and was affirmed as a final order on June 23, 2022, with respect to a workplace located at or near 4124/4126 Silver Boulevard in Bismarck, North Dakota.
