29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On July 25, 2023, at the above address, employees were exposed to cave-in hazards while performing work in an unprotected excavation of approximately six (6) feet two (2) inches deep. The employer did not ensure that employees were protected from cave-in hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. Mauro Sewer Construction, Inc. was previously cited for a violation of this occupational safety and health standard 1926.652(a)(1), which was contained in OSHA inspection number 1500388, citation number 2, item number 1, and was affirmed as a final order on March 29, 2021, with respect to a workplace located at Cherry and Wisner Streets in Park Ridge, Illinois.
