29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, are not protected by protective helmets: (a) The employer is failing to protect each employee working in areas where there is a possible danger of head injury from impact or falling or flying objects. This practice led to employees being unprotected from head injuries on July 17, 2023, where they were working below re-roofing operations where there was a danger of head injury from impact and falling or flying objects at 20454 E Hampden Place, Aurora CO 80013. Employees were not protected by protective helmets. To abate this violation, the employer must come into compliance with this standard at all of its job sites to ensure that no employees enter areas below active roofing operations until protection is provided. Abatement Note: Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from the hazards of falling or flying object hazards. (An abatement plan, periodic progress reports, and provision of site addresses may be required if the abatement period is more than 90 days.)
