29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. This is applicable to shipyard employment by 1915.154 that incorporates the General Industry requirement: Respiratory Protection Program: The employer requires employees to don tight-fitting respirators to protect against health hazards associated with organic vapors from marine paints and varnishes, and dust generated when grinding or sanding vessel surfaces. Medical evaluations have not been provided as required. The Bayside Boatworks, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number1388699, citation number 1, item number 1/a, and was affirmed as a final order on 09-10-2019, with respect to a workplace located at 2360 Marinship Way Sausalito, CA 94965.
