OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards when working in the same area as moving equipment: a) Silage bunker worksite: On June 9, 2023, employees involved with a continuous cover of a silage bunker were attempting to hold and place a plastic tarp (silage film) over the silage pile in windy conditions. A skid steer was staging bundles of tire sidewalls on the silage pile in the same area and at the same time, exposing the workers to the hazards of being struck-by and run over by the skid steer.
