29 CFR 1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a) 30 Wilson Avenue, New Square, NY: On or about 5/31/23, employees installing roof sheathing used pneumatic nail guns and the employer did not ensure that eye protection (e.g., safety glasses or equivalent) was used by employees exposed to eye loss/eye injuries due to struck by hazards. b) 50 Wilson Avenue, New Square, NY: On or about 6/5/23, employees installing roof sheathing used pneumatic nail guns and the employer did not ensure that eye protection (e.g., safety glasses or equivalent) was used by employees exposed to eye loss/eye injuries due to struck by hazards. c) 50 Wilson Avenue, New Square, NY: On or about 6/7/23, employees installing roof sheathing used pneumatic nail guns and the employer did not ensure that eye protection (e.g., safety glasses or equivalent) was used by employees exposed to eye loss/eye injuries due to struck by hazards. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
