OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to struck-by hazards in case of forklift collision or tip-over where seatbelt was not used in the following instances: a) On or about May 15, 2023, in the Warehouse (between the racking systems), the forklift operator was operating forklift without use of a seatbelt. b) On or about May 16, 2023, in the Screw Machine Bldg. (near the entrance doors), the forklift operator was operating forklift without the use of a seatbelt. c) On or about June 6, 2023, Department 7, Swiss Machine Building (near the Davenport Machines), the forklift operator was operating forklift without the use of a seatbelt.
