29 CFR 1910.132(d)(1)(i):When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazard. a. Alfred Nickles Bakery, Inc. - Lima, Ohio: On or about May 7, 2023, the employer did not perform an adequate hazard assessment to determine the proper protective equipment to be worn by employees working in the Bun Line Finishing Department who are exposed to laceration injuries when handling bread slicer blades during blade changes. b. Alfred Nickles Bakery, Inc. - Lima, Ohio: On or about May 11, 2023, the employer's hazard assessment did not identify protective equipment to be worn by employees working in the Bun Line Finishing Department who are exposed to eye injuries when compressed air is used to clean. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
