29 CFR 1910.29(b)(3): The employer must ensure guardrail systems are capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied in a downward or outward direction within 2 inches (5 cm) of the top edge, at any point along the top rail: At an establishment located at 805 Ogden Street in Marinette, Wisconsin; a) On or about May 12, 2023, to August 17, 2023, the employer did not ensure the freestanding guardrail installed to protect employees from fall hazard on the southeast side of Autopour #1 was capable of withstanding a force of at least 200 pounds. The guardrail was missing a weighted base at one end and was bent and damaged to the point that the system would fail to prevent a fall into the pit beneath the autopour. b) On or about May 12, 2023, to August 17, 2023, the employer did not ensure the freestanding guardrail installed to protect employees from fall hazard on the southeast side of Autopour #2 was capable of withstanding a force of at least 200 pounds. The guardrail was missing a weighted base at one end and was bent and damaged to the point that the system would fail to prevent a fall into the pit beneath the autopour. c) On or about May 12, 2023, to August 17, 2023, the employer did not ensure the freestanding guardrail installed to protect employees from fall hazard on the southeast side of Autopour #3 was capable of withstanding a force of at least 200 pounds. The guardrail was missing a weighted base at one end and was bent and damaged to the point that the system would fail to prevent a fall into the pit beneath the autopour. d) On or about May 12, 2023, to August 17, 2023, the employer did not ensure the freestanding guardrail installed to protect employees from fall hazard on the southeast side of Autopour #4 was capable of withstanding a force of at least 200 pounds. The guardrail was missing a weighted base at one end and was bent and damaged to the point that the system would fail to prevent a fall into the pit beneath the autopour. e) On or about May 12, 2023, to August 17, 2023, the employer did not ensure the freestanding guardrail installed to protect employees from fall hazard on the southeast side of Autopour #5 was capable of withstanding a force of at least 200 pounds.
