Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walkingworking surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii). a) Seneca Dairy Systems, LLC, 3236 N Hoster Road #9594, Seneca Falls, NY 13148: On or about 5/1/2023, Employer did not ensure each employee on the second level of the covered racking in the yard was protected from falling by use of guardrails, safety net system, or personal fall arrest system, exposing employee to a fall distance of approximately 6 feet 4 inches. b) Seneca Dairy Systems, LLC,3236 N Hoster Road #9594, Seneca Falls, NY 13148: On or about 5/1/2023, Employer did not ensure each employee utilizing the Raymond order picker, model # 261-OPC30TT, Serial #261-03-02303 was protected from falling by use of guardrails, safety net system, or personal fall arrest system, exposing employee to a fall distance of approximately 9 feet 4 inches.
