29 CFR 1926.21(b)(2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a) On or about April 13, 2023, at the worksite located at 236 W Broadway Street, Waukesha, WI 53186, the employer did not ensure that an adequate protective system was used in a trench to protect employees from potential trench collapse hazard. Specifically, two (2) employees were in the trench while a concrete box was being lowered into the trench.
