29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: On or about March 13, 2023, at the tunnel of Silo #1 and Silo #2, employees entered the tunnel under the silos that contained atmospheric hazards such as but not limited to phosphene, nitrogen dioxide, and carbon monoxide gases to extend a conveyor. A written confined space program had not been developed and implemented.
