OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by, impalement, and crushing hazards during livestock movement in alleys and into holding pens. On or about March 15, 2023, and at times prior, employees working in the livestock alleys and penning area were exposed to struck-by, impalement and crushing hazards when trying to move livestock (particularly bulls) through the alleys into holding pens. While moving livestock, employees open and close a series of swing gates while in close proximity to the livestock resulting in potential struck -by, impalement, and crushing hazards directly from livestock and livestock forcefully contacting gates.
