OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to caught under and/or struck-by hazard. Location: a) On the second floor of the jobsite at 126 Lafayette Street, New York, NY 10013: On or about March 7, 2023, a masonry wall was used as a retaining wall against piled debris and was incapable of safely supporting the imposed load. Employees were exposed to caught under and struck-by hazards. The employer permitted employees to work where such hazards existed without correcting them by shoring, bracing, or other effective means.
