29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. On or about March 7, 2023, employees installed utility/drainage pipes on the site's northeast side in an excavation that was not inspected throughout the shift for evidence of a situation that could have resulted in possible cave-ins. If inspected by a competent person, they would have discovered that the excavation did not have a means of egress or cave-in protection in class "c" soil in an excavation deeper than five (5) feet or that a means of egress was not present in the excavation that was deeper than four (4) feet.
