29 CFR 1910.146(d)(3)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including specifying acceptable entry conditions: a. On or about March 2, 2023, the employer did not specify acceptable and safe entry conditions for employees assigned to enter permit spaces, such as the #4029 Mississippi Tank Company manufactured tanker trailer. An employee who entered the trailer to conduct an inspection was exposed to atmospheric hazards, such as oxygen deficiency and flammable gasses. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
