29 CFR 1926.651(i)(3):Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures. On or about March 2, 2023, during the replacement of storm sewers and storm water catch basins at a worksite located at 107 Barberry Dive, Berea, Ohio, the employer did not ensure an employee working inside a trench was protected from collapse of undermined pavement (asphalt and concrete) by a support system, removal, or other method of protection.
