OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to serious crushing type injuries associated with operation of the underhung crane/hoist that had a damaged safety latch on the hook. a. On or about February 13, 2023, and at times prior, in the Loading Dock Area on the 10 metric ton underhung crane/hoist, there was not a functional safety latch mechanism in place on the hook to close the hook's throat and secure loads when employees operated the crane/hoist to lift steel coils, steel I-beams, and other finished and unfinished steel materials weighing up to approximately 8,410 pounds. Employees were thereby exposed to crushing injuries and death associated with being struck-by a fallen load while they operated the crane/hoist with the damaged safety latch.
