29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 01/31/2023, during the renovation project for a new Tesla Automotive Service Center, located at 3535 West Henrietta Road, in Rochester, New York, the employer did not enforce the use of fall protection when employees were installing exterior composite siding along the roof edge measuring 24 feet 6 inches above lower levels. Employees were allowed to work without fall protection and exposed to fall hazards. NO ABATEMENT CERITFIICATION REQUIRED
