OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards due to a collapse or tip-over of a storage rack system: a) Warehouse; On or about January 18, 2023, and times prior, employees used forklifts to load and unload material on the storage rack system. Employees were exposed to crushing hazards from a collapse or tip-over of a storage rack system due to unanchored rack columns that affected the stability of the storage rack system.
