OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by wood building components in the event of structural collapse: (a) Under-construction residential building; On or about January 10, 2023, rigging equipment used to lift and place 70-foot long trusses (long-span trusses) did not include the use of a spreader bar or stiff back at least 2/3 to 3/4 of the truss with connections at least every 10 feet to prevent lateral bending of the truss during handling and installation operations. (b) Under-construction residential building; On or about January 10, 2023, adequate bracing/restraint and rigging methods were not provided for a partially-constructed roof truss structure trusses of an under-construction 150 foot long by 70 foot wide garage/shop during the installation of approximately thirty 70-foot long metal connected wood-framed scissor trusses (long-span trusses) being placed atop 18-foot tall wood-framed exterior walls. On or about January 11, 2023, employees were exposed to the hazards of being struck by building components while performing framing work on exterior walls when the previously set trusses and walls (north, east, and west) collapsed and fell to the interior concrete foundation.
