29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) Off the intersection of Tanger Outlet Blvd and Amalfi Blvd, left side trench #1: On or about January 11, 2023, the employer exposed employees to struck-by and crushing hazards, in that employees worked inside a trench that was 4 feet 10 inches deep with a spoil pile directly next to the excavation. (b) Off the intersection of Tanger Outlet Blvd and Amalfi Blvd, right side trench #2: On or about January 11, 2023, the employer exposed employees to struck-by and crushing hazards, in that employees worked inside a trench that was 4 feet 6 inches deep with a spoil pile directly next to the excavation.
