29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. On or about December 29, 2022, and at times prior, the employer did not ensure that prior approval was received from the manufacturer prior to modification to add the MSI Part 2007 (EZZ-060222023) attachment to the Crown RC5500 stand-up/counterbalance forklift. The capacity, operation, and maintenance instruction plates, tags and decals were not changed accordingly. Employees were thereby exposed to struck-by injuries.
