OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees in a bucket of excavator were exposed to falling from the bucket. On or about November 30, 2022, an employee was exposed to falling 15-feet into the excavation when the employee was hoisted in the bucket of a Caterpillar Excavator to perform work on a pipe near grade level.
