OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck-by and crushed-by hazards: (a) On December 11, 2022, the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee who was driving/operating a John Deere 5300 Series tractor dismounted the machine while it was still in forward motion to clear material in its path. The employee fell when he attempted to get back on the tractor and was run over by a rear tire thus resulting in his hospitalization. This condition exposed the employee to struck-by and crushing hazards. (b) On or before December 11, 2022, the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on multiple occasions employees who drive/operate tractors, such as the John Deere 5300 Series tractor, dismount while in forward motion to clear material in its path. This condition exposed the employee to struck-by and crushing hazards. Among other methods, feasible and acceptable abatement methods to correct this hazard is to perform the following: 1. Adhere to the manufacturer's warnings and directions printed in the operator's manual, which state that the operator is to place the John Deere tractor in park before dismounting. 2. Establish an effective standard operating procedure and training program regarding safe work practices and correct utilization of equipment and materials.
